OFFICIAL CONTESTANT RULES & REGULATIONS BACHELOR PARTY PRIZE PACKAGE CONTEST
April 24, 2006 – June 30, 2006
1. Hooters Magazine, LLC (“HM”) will conduct the Bachelor Party Prize Package Contest (“Contest”) during the above listed dates for a chance to win the following, as more fully defined and limited below:
Montreal VIP $5000 Gift Package, Tap & Serve Kegerator, Slimdevices Squeezebox, Coby DVD Home Theater System, Envision 42” HDTV Plasma Screen TV, Arctic Iceshots, Takeout Menu Organizer, Lite-up Ice Cubes, Suck UK Magnetic Bottle Opener, Not Neutral Green Link Retro Shooters, Beer-o-matic Retro Vending Machine, Runner Donut Coasters, 10 Player Big Time Texas Hold ‘Em Poker Table, 60 Shotpak Shots, Pure Digital One Time Use Video Camera, Logitech Digital iPod Speakers, Viosport Adventure Cam 3, Graffiti Garments Stagjacket, Reel Deal Slots “BONUS Mania” PC Video Game, Real Deal “VEGAS” Casino PC Video Game, Shocking Liar Lie Detector, Lightning Reaction Game, AlcoHawk’s Slim, JVC Home Theater in a Box, Jimi Wallet w/Lanyard Attachment, Logitech Cordless Precision Xbox Controller, Logitech Cordless Action PS2 Controllers, Emer’gen C, JVC UX-G70 Stereo System, iJoy 300, Dirt Devil Kone Vacuum, & Flowerbud Gift Certificate (“Prize”).
2. Only one (1) Prize will be awarded. Winning Contestant will win all items described in Paragraph 1 above. Contestants may enter the Contest as follows:
(a) Beginning on April 24, 2006, Contestant will provide in writing, a paragraph describing why the Contestant should win the Prize.
(b) Contestant shall submit the entry in writing, either of two ways:
(1) By logging on to the HM web site (www.hootersmagazine.com) and then entering, where directed, a paragraph describing why the Contestant should win the Prize, along with the Contestant’s name, mailing address, e-mail address, and other designated contact information. All web site entries must be made on or before June 30, 2006;
-or-
(2) By sending to “Bachelor Party Prize Package Contest”, 1815 The Exchange, Atlanta, Georgia 30339, a postcard containing the following information: a written paragraph describing why the Contestant should win the Prize, and the contestant’s full name, mailing address, and home telephone number. All postcard entries must be received on or before June 30, 2006.
Limit one entry per Contestant, either on the official web site or via U.S. mail. Only handwritten entries will be accepted by mail; no mass mailed, duplicate or machine generated mailed entries will be accepted. Mailed entries must consistently use the same, identical name, mailing address and home telephone number to be accurately recorded and logged for Contest purposes. Contestants are solely responsible for correctly and timely entering/supplying all required entry information
3. On or about July 10, 2006, one entry will be selected as the Prize Winner from a pool of those qualified persons who have correctly provided all necessary information. All decisions/selections shall be determined by officials and/or management of HM and shall be final. One alternate ballot will be selected in the event the Prize Winner cannot meet any and all Contest requirements. The Prize Winner will be notified via certified mail, return receipt requested, mailed on or before July 15, 2006.
4. In the event that weather or other intervening force majeure event(s) makes participation in any Prize activities impossible or impractical, in the sole and exclusive discretion of applicable HM officials, then a reasonable effort will be made to reschedule such activities at a later date. HM shall not be responsible for Prize Winner’s unavailability on any or all offered alternate dates. Prize must be redeemed within twelve (12) months from the date of award.
5. The Contest is open to U.S. residents twenty-one (21) years of age and older only. Employees of HM and Hooters of America, Inc. (“HOA”), their related or affiliated companies, their related sponsors and their immediate family members, may not participate in, and are not eligible to win, any Prize awarded as part of the Contest. The term “immediate family members” includes spouses, grandparents, parents, siblings, children, and grandchildren.
6. Any difficulties with getting to locations, or acquiring the means, to participate in the Contest are not the responsibility of HM.
7. The Prize Winner will be required to sign a Release form which, among other things, releases HM, HOA, and their related or affiliated companies and other entities, and their representatives, owners, agents and employees, from any liability whatsoever related to the conduct of the Contest and/or the participation of any Winner in the Prize thereunder, before any Prize will be awarded. A copy of the release form is available by mailing a request to “Bachelor Party Prize Package Contest,” 1815 The Exchange, Atlanta, Georgia 30339. Prize Winner will be solely responsible for all applicable title fees, registration fees, and taxes including state, local, and federal taxes resulting from the award of any Prize, and therefore may be required to present a valid Social Security Card before claiming the Prize.
8. Winner, as a condition of winning any and all Prizes hereunder, shall acknowledge and agree that HM, HOA, and/or their related or affiliated entities, shall have the right to, without further authorization, publicize his or her name, character likeness, photograph, voice, and the fact that he or she is a Winner for promotional purposes, without financial remuneration.
9. There is no purchase necessary to enter or win the Contest. Void where prohibited.
10. There will be no substitution for prizes. Participation in the Contest and prizes awarded are non-transferable. Failure to collect any prize constitutes forfeiture of the prize. If forfeited, any prize will remain the property of HM and/or HOA. Another winner will not be selected, except as provided above.
11. HM and/or HOA reserve the right to make rule or Contest changes without notice and at any time, and reserve the right to change the aforementioned Contest date(s) without notice.
12. Any decision by HM and/or HOA management, in their sole discretion, in the interpretation and/or application of these rules shall be final. By participating, persons agree to be bound by the decisions of HM, HOA, any judges, and the official rules.
13. If any Winner is found in violation of any one or more of these rules, he/she may be required to forfeit any and all Prizes awarded.
14. HM and HOA, together with their related or affiliated companies and other entities, and their representatives, owners, agents and employees, are not responsible for any liabilities arising directly or indirectly from the award of or participation in any Prize(s) .
15. HM and HOA, together with their related or affiliated companies and other entities, and their representatives, agents and employees, are not responsible for any changes to or difficulties in Prize delivery, or for any lost, stolen or misdirected entries.
16. The odds of winning are based on, and/or influenced by, the number of Contest entries.
17. HM, and Hooters are registered marks, and participation in this contest in no way entitles any contestant to use any registered marks of HM, Hooters of America, Inc. or any of their related or affiliated companies or other entities without express permission. On TV/promotional materials, state: “Contest open to U.S. residents 21 years of age or older. No purchase necessary. Void where prohibited. See official Contest rules for details.”
